These Terms and Conditions ("Terms") govern your use of the AutoCaptioner mobile application (the "App"), developed and maintained by Dipankaj Singh, operating as DipDev Labs ("we", "us", or "our"). By downloading or using the App, you agree to these Terms. If you do not agree, please do not use the App.

1. Acceptance of Terms

By installing, accessing, or using AutoCaptioner, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users of the App.

We are an independent developer, not a corporation. These Terms are written to be clear and fair, not to obscure your rights.

AutoCaptioner is an Android application that empowers creators with on-device AI tools for video recording and editing. Its core features include:

The App is currently free to use. We plan to offer digital in-app purchases in a future release to unlock premium features ("AutoCaptioner Pro"). When offered, the following terms will apply:

Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on your Android device solely for your personal, non-commercial purposes (unless you are using the App to create content for your own commercial channels, which is permitted).

The AutoCaptioner application, including its source code, design, branding, and user interface (excluding open-source components), is the intellectual property of Dipankaj Singh / DipDev Labs. All rights not expressly granted in these Terms are reserved.

AutoCaptioner's speech recognition capability is powered by OpenAI's Whisper models, which are made available under the MIT License. Use of the Whisper models is subject to OpenAI's open-source licence terms. We gratefully acknowledge the open-source community whose work makes this App possible.

Your videos, audio, text scripts, and content remain entirely your own. We claim no ownership over any media you process using the App.

You agree to use the App lawfully and responsibly. You are solely responsible for:

7. Disclaimer of Warranties

The App is provided "as is" and "as available", without warranties of any kind, either express or implied. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to:

You use the App at your own risk. Always review generated captions and edited videos before publishing or distributing them.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Dipankaj Singh / DipDev Labs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App. This includes but is not limited to loss of data, loss of profits, or any damages resulting from incorrect captions.

Our total liability to you for any claim arising out of or relating to these Terms or the App shall not exceed the amount you paid for the App (if any) in the twelve months preceding the claim. Where the App is provided free of charge, our maximum liability is zero.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of the above may not apply to you.

9. Social Media & User Generated Content (UGC)

If you use AutoCaptioner to generate captions for videos that you subsequently export and upload to third-party platforms (like TikTok, Instagram, YouTube, etc.), you are solely responsible for ensuring that your content complies with the terms of service and copyright policies of those respective platforms. We bear no liability for content takedowns, copyright strikes, or account suspensions resulting from media you process with our App.

10. User Indemnification

You agree to indemnify, defend, and hold harmless Dipankaj Singh and DipDev Labs from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including but not limited to attorney's fees) arising from: (i) your use of and access to the App; (ii) your violation of any term of these Terms; or (iii) your violation of any third-party right, including without limitation any copyright, property, or privacy right.

11. Dispute Resolution & Class Action Waiver

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, shall be resolved through binding arbitration, rather than in court. You and DipDev Labs agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

12. Third-Party Services & Google Play EULA

The App integrates with services operated by Google LLC (including Firebase Crashlytics, Firebase Analytics, Firebase Performance Monitoring, Firebase Remote Config, and Google Play Billing). By using the App, you also agree to their applicable terms and policies:

These services collect diagnostic, usage, and performance data as described in our Privacy Policy. At no point do these services receive your video files, audio recordings, camera frames, or generated content.

Google Play EULA Acknowledgment: You acknowledge that these Terms are concluded between you and DipDev Labs only, and not with Google LLC. DipDev Labs is solely responsible for the App and its content. Google has no obligation whatsoever to furnish any maintenance and support services with respect to the App, and Google is a third-party beneficiary of these Terms.

13. Changes to Terms

We may update these Terms from time to time as the App evolves. When we make material changes, we will update the "Effective Date" at the top of this page. We encourage you to review these Terms periodically. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

We will always aim to be transparent about what changes and why, in keeping with our commitment to user trust.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, with exclusive jurisdiction in the courts of Delhi, India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the competent courts in Delhi.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
